Today, the Military Court Reads the Charges in the Murder of Kacab Bank

JAKARTA – The Military Court II-08 Jakarta today, Monday, held a trial to read the charges against the defendant in the alleged kidnapping and murder of a branch head (kacab) of a bank in Jakarta with the initials MIP (37).

“The agenda for today’s hearing is the reading of the indictment from the Military Audit II-07 Jakarta against the three defendants,” said Jakarta Military Court II-08 Spokesperson Endah Wulandari, quoted by Antara, Monday, May 18.

The three defendants, namely Serka MN (defendant 1), Kopda FH (defendant 2), and Serka FY (defendant 3), are suspected of being involved in a series of kidnappings accompanied by the murder of MIP.

The trial is scheduled to take place in the afternoon, around 12.00 WIB in the Garuda Courtroom or the main courtroom.

“Because the panel of judges has activities, the trial is planned to begin after Ishoma (around 12 o’clock in the afternoon),” said Endah.

Details of the indictment

Another Military Auditor, Major (Chk) Wasinton Marpaung, said in the case, three soldiers who were defendants, namely Serka MN (defendant 1), Kopda FH (defendant 2), and Serka FY (defendant 3).

The three are suspected of being involved in a series of kidnappings and murders of MIP victims.

For the first defendant, Serka MN, the oditur drafted a layered indictment. In the first indictment, MN was charged with Article 340 of the Criminal Code in conjunction with Article 55 paragraph (1) of the Criminal Code as a primary indictment. This article regulates premeditated murder committed together.

As a backup, Serka MN was also charged with Article 338 of the Criminal Code in conjunction with Article 55 paragraph (1) of the Criminal Code as a subsider, as well as Article 351 paragraph 3 of the Criminal Code in conjunction with Article 55 paragraph (1) of the Criminal Code as a more subsider.

“In addition, there is an alternative charge under Article 333 paragraph 3 of the Criminal Code regarding the deprivation of liberty that causes death,” said Wasinton.

Not only that, MN was also charged with cumulative Article 181 of the Criminal Code regarding the alleged concealment of the victim’s body.

Meanwhile, the second defendant, Kopda FH, was also charged with a similar pattern, namely Article 340 of the Criminal Code as a primary charge, with the backup of Article 338 and Article 351 paragraph 3 of the Criminal Code. FH was also charged with an alternative charge of Article 333 paragraph 3 of the Criminal Code.

Likewise, the third defendant, Serka FY, was charged with a construction of almost identical articles, ranging from premeditated murder to deprivation of independence which led to death.
