Kerala Waqf Board To Seek Review Of HC Division Bench Verdict On Munambam Land

The Kerala Waqf Board (KWB) has decided to file a review petition challenging the Kerala High Court Division Bench’s verdict that declared the disputed Munambam land as not a Waqf property, reported The Hindu.

The Division Bench, comprising Justice Sushrut Arvind Dharmadhikari and Justice V. M. Shyamkumar, delivered the judgment last month while considering a State government appeal against a Single Judge’s order that had cancelled the appointment of C N Ramachandran Nair as the Commission of Inquiry into the Munambam issue.

According to sources, the KWB will argue that the Bench committed an error apparent on the face of the judgment and exceeded its judicial mandate by ruling on a matter not raised by any of the litigants.

The Board contends that the court went beyond its jurisdiction by determining the ownership status of the property—a matter that should have been left to the Waqf Tribunal.

The Board also plans to contest the Bench’s decision to set aside the registration of the Munambam land as Waqf property and its remarks regarding delays in registration. A Waqf Board meeting last week reviewed legal advice on the matter before deciding to pursue a review.

The KWB maintains that the Division Bench’s ruling constitutes judicial overreach, potentially undermining the authority of the Waqf Tribunal, where the Munambam land case is still pending.

The Tribunal, chaired by District Judge T K Minimol, will hear the case on 6 November, including petitions from the Board, residents of Munambam, and the legal heirs of Mohammed Siddique Sait, who had donated the land to Farook College, Kozhikode.
